Private Wealth Law

Structuring, transferring and protecting wealth within a secure legal framework.
I advise clients on private wealth law at every stage of the structuring, management and transfer of their private and professional assets. My approach combines civil law, tax law and private international law to provide strategic guidance tailored to personal and family circumstances.

Wealth Organisation: marital regimes and forward planning

The legal structuring of wealth requires early consideration of the rules applicable to couples and property ownership:

  • analysis and choice of marital regime (community, separation of property, participation in acquisitions),
  • drafting or amending marriage contracts,
  • civil partnerships (PACS) and their patrimonial consequences, and
  • prevention and assistance in the event of separation or divorce, taking into account both civil and tax implications.

Wealth Transfer: legally framing intentions

I assist with the transfer of wealth, whether anticipated or upon death, within a secure legal framework:

  • drafting and implementing testamentary strategies,
  • lifetime gifts: simple gifts, shared gifts (donations-partage), manual gifts,
  • shared liberalities aimed at preserving family balance,
  • succession planning, including analysis of forced heirship rules, joint ownership (indivision) and inheritance arrangements, and
  • coordination with the related tax implications (transfer duties, latent capital gains, usufruct reversion clauses, etc.).

Divorce and matrimonial property division

I assist clients in all types of divorce proceedings, whether by mutual consent (amicable divorce without a judge) or contentious divorce (on grounds of fault, irretrievable breakdown of the marriage, or acceptance of the principle of separation). I also handle international divorces involving foreign elements, requiring the application of private international law and, where necessary, coordination with foreign counsel.

 

My assistance covers the determination of child support, spousal maintenance during proceedings, and the assessment of spousal compensatory payments to ensure they are set fairly in light of the couple’s economic and patrimonial situation.

 

I also intervene in the liquidation and division of matrimonial property regimes (community property, separation of assets, participation in acquisitions), including the analysis, valuation and distribution of real estate, business assets and private wealth.

Private International Law: cross-border families and estates

In an increasingly mobile environment, I frequently act in matters with an international dimension:

  • determining the law applicable to marital regimes or succession,
  • anticipating conflicts of laws and jurisdictions,
  • implementing European regulations (Regulation No. 2016/1103 on matrimonial property regimes, Regulation No. 650/2012 on successions), and
  • coordinating with foreign professionals (notaries, lawyers, banks) to ensure consistency of wealth planning on a global scale.
